Disclaimer and terms of use of tools

Cross reference search engine and Calculation Software are software tools provided by Area Cooling Solutions S.A.U. to assist in the selection of compressors, including precision mechanical controls for refrigeration and air conditioning applications (the “Tools”). The Tools support product selection based on installation location, application, accessibility class, and applicable standards.

The Tools, and all information contained in or generated by them, are provided on an “as is” and “as available” basis. Area Cooling Solutions S.A.U. makes no representations or warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the Tools, their outputs, or any materials made available through them. Area Cooling Solutions S.A.U. does not warrant that the Tools are free from errors, interruptions, viruses, or other harmful components.

Any running cost information is provided for comparison purposes only. Actual operating costs may differ from the values generated by the Tools, and Area Cooling Solutions S.A.U. shall not be liable for any such differences.

Area Cooling Solutions S.A.U. shall not be liable for any issues arising from the application or use of compressors, condensing units, or flow controls selected using the Tools. The user remains solely responsible for verifying all information contained in or generated by the Tools and for determining the suitability of Area Cooling Solutions products for incorporation into the user’s equipment and for the intended end-use application.

Area Cooling Solutions S.A.U. assumes no responsibility or liability for any claims, losses, or damages arising out of or related to the use of the Tools, particularly where appropriate risk management measures have not been adequately implemented by the user.

Area Cooling Solutions S.A.U. shall not be responsible for how any risk assessment is performed or used, nor for its content or conclusions. Nothing in any such assessment shall override any legal, regulatory, or code-of-practice requirements applicable to the user or the relevant application.

To the fullest extent permitted by applicable law, Area Cooling Solutions S.A.U., its affiliates, agents, suppliers, officers, directors, and employees expressly disclaim all warranties, whether express, implied, or statutory, including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement of third-party rights.

To the fullest extent permitted by applicable law, Area Cooling Solutions S.A.U. disclaims all liability for any loss, injury, claim, liability, or damage of any kind resulting from or related to:

• Errors in or omissions from the Tools or their content, including technical inaccuracies or typographical errors;
• Third-party websites, applications, software, or content accessed directly or indirectly through links made available in connection with the Tools;
• The unavailability of the Tools, their content, or any part thereof;
  the use of the Tools or any equipment or software used in connection with them; and
• Technical problems or malfunctions affecting networks, systems, servers, internet service providers, computer equipment, or software, including any damage to the user’s or any other person’s equipment resulting from use of the Tools.
